1. Acceptance of Terms

By accessing or using whynotapply.me (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

The Service is operated by Individual Entrepreneur Anastasiia Veselova, registered in Georgia (Identification Number: 305532616), hereinafter referred to as "we," "us," or "whynotapply."

2. Description of the Service

whynotapply is an AI-powered platform that generates tailored resumes, cover letters, and company briefs based on job descriptions and candidate information you provide. Each generation is a unique, on-demand output produced specifically for your inputs.

The Service is provided "as is" and features may change over time. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

3. Accounts & Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate registration information (name, email address)
• Keep your account credentials secure and not share them with others
• Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments, Credits & Billing

The Service operates on a pay-per-generation model. You purchase generation credits in advance; each generation consumes one credit from your balance.

Payment processing: All payments are processed by Keepz.me, who acts as the Merchant of Record for all transactions. Your payment information is handled directly by Keepz and is subject to Keepz's Privacy Policy. Keepz is responsible for billing, invoicing, and applicable tax compliance.

Credits: Purchased credits have no expiry date and remain available in your account until used. Credits are non-transferable and have no cash value.

All prices are shown in USD and are inclusive of any applicable fees. Keepz may collect and remit applicable taxes on our behalf depending on your jurisdiction.

5. Your Content

You retain ownership of all content you upload or provide to the Service, including your CV, work history, and personal information ("Your Content").

By using the Service, you grant us a limited, non-exclusive license to process Your Content for the sole purpose of generating your requested outputs. We do not use Your Content to train AI models or share it with third parties except as described in our Privacy Policy.

You represent and warrant that:

• You have the right to submit all content you provide
• Your content does not infringe any third-party rights
• The information you provide is accurate and relates to your own professional history

6. Intellectual Property

The whynotapply platform, including its design, software, prompts, and underlying systems, is owned by us and protected by applicable intellectual property laws.

Generated outputs (resumes, cover letters, company briefs) produced from Your Content are provided to you for personal, non-commercial use in your own job applications. You may not resell, sublicense, or distribute generated outputs as a service to others.

7. Prohibited Use

You agree not to:

• Use the Service to generate content for someone other than yourself without their explicit consent
• Attempt to reverse-engineer, scrape, or extract the underlying AI prompts or systems
• Use automated tools to abuse the generation system
• Submit false, misleading, or fraudulent information
• Use the Service in any way that violates applicable law

whynotapply is designed exclusively for individual job seekers. Commercial or bulk use is strictly prohibited. If we determine that an account is being used for commercial purposes, resale, agency workflows, or automated bulk generation — we reserve the right to permanently suspend the account without prior notice and without refund of any purchased credits.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that generated outputs will guarantee employment outcomes, that the Service will be uninterrupted or error-free, or that generated content will meet every employer's specific requirements.

9. Limitation of Liability

To the maximum extent permitted by applicable law, whynotapply and Individual Entrepreneur Anastasiia Veselova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or failure to obtain employment, arising from your use of the Service.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Account Suspension

You may stop using the Service at any time. We may suspend or block access to your account if you violate these Terms, with or without prior notice depending on the severity of the violation.

In either case, any remaining generation credits are not refunded. All sales are final per our Refund Policy.

11. Governing Law

These Terms are governed by the laws of Georgia. Any disputes arising from these Terms shall be resolved in the courts of Georgia, unless otherwise required by applicable consumer protection law in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by displaying a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
